3. SMS Communications and Consent
Our Services involve sending SMS and text messages to your customers or leads on your behalf. By using our Services, you represent and warrant that:
- You have obtained all necessary consents from recipients prior to sending them SMS communications through our platform.
- All SMS communications comply with applicable laws, including the Telephone Consumer Protection Act (TCPA) and FCC regulations.
- You will not use our Services to send unsolicited messages, spam, or any communications that violate applicable law.
- You will maintain records of all required consents.
Recipients may opt out of SMS communications at any time by replying STOP. You agree to honor all opt-out requests promptly.
4. Acceptable Use
You agree not to use our Services to violate any applicable law, send unsolicited or misleading communications, impersonate any person or entity, transmit harmful or objectionable content, or interfere with the integrity of our Services.
5. Client Responsibilities
You are solely responsible for the content of communications sent through our platform, ensuring all recipients have provided proper consent, compliance with all applicable laws, and maintaining the accuracy of your business information and contact data.
6. Payment Terms
Fees for our Services will be outlined in your service agreement or order form. All fees are non-refundable unless otherwise stated in writing. We reserve the right to modify pricing with reasonable notice.
7. Intellectual Property
All content, trademarks, service marks, logos, and intellectual property on our website and within our Services are the property of Core Exchange LLC or our licensors. You may not use, reproduce, or distribute any of our intellectual property without our express written permission.
8. Disclaimer of Warranties
Our Services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not warrant that our Services will be uninterrupted, error-free, or completely secure.
9. Limitation of Liability
